CreatorWise is a SaaS platform powered by artificial intelligence that helps content creators discover viral content in their niche, analyze what makes it perform, and generate personalized content ideas through conversational AI.

Access and Use of the Service

• Access requires the creation of a user account.
• You are responsible for keeping your login credentials confidential.
• CreatorWise reserves the right to suspend or terminate access in case of abuse or violation of these Terms.

Authorized Use

• Do not upload or transmit illegal, defamatory, violent, or infringing content.
• Do not attempt to bypass the Platform's security systems.
• Use the service only within the limits permitted by law.
• Do not use the service to spam, harass, or violate the terms of service of third-party platforms (Instagram, TikTok, etc.).

Data Processing and Subprocessors

CreatorWise processes data in compliance with the GDPR and does not sell or rent this data.

Intellectual Property

• You retain full rights over the content and data you upload or integrate.
• CreatorWise does not claim any rights over your content or generated ideas.
• The code, brand, and graphical elements of CreatorWise remain the exclusive property of Simon Bellucci.
• Content analyzed from third-party platforms remains the property of the original creators.

Subscriptions and Payments

• Pricing and plans are available on our official website.
• Subscriptions are billed monthly based on token consumption and feature access.
• For consumer users, you have a 14-day right of withdrawal, except in cases where the service is executed immediately after your express consent.
• Token limits reset monthly according to your billing cycle.

Limitation of Liability

• The service is provided "as is" without any guarantee of error-free or uninterrupted availability.
• CreatorWise cannot be held liable for indirect losses resulting from the use of the service.
• The user is solely responsible for the content they create based on ideas generated by the Platform.
• CreatorWise does not guarantee specific performance results from using generated content ideas.
• Accuracy of scraped data from third-party platforms depends on those platforms' APIs and may be subject to limitations or changes.

Termination

• You may delete your account at any time from your user space or by written request.
• CreatorWise may suspend or terminate an account in case of violation of these Terms.
• Upon termination, access to the Platform and all generated content will be permanently removed.

International Transfers

Some processing (Vercel, Anthropic, Fal.ai) involves transfers of data outside the EU.

These transfers are governed by Standard Contractual Clauses (SCC), ensuring an adequate level of protection.

Governing Law and Jurisdiction

These Terms are governed by French law.

Any dispute shall be brought before the competent courts of Mulhouse (place of establishment), unless mandatory consumer protection provisions apply.

Changes

CreatorWise may amend these Terms at any time.

In the event of a substantial change, users will be informed by email or via the Platform.
